Digital purchases
You may purchase digital items using the following methods of payment: credit/debit card through the Paypal service.
Digital items are in general available for download on their release date. On rare occasions, items may not be available for technical reasons.
Confirmation that the items are available for download will be provided upon checkout from Paypal. A unique will be provided after the checkout process from where the download can be obtained.
Email confirmation of this link will also be provided to your email account. This link will be available to you for a period of 24 hours after which the link will no longer be active.
Credit and debit cards are debited on the day the items are made available for download, for the price indicated at the time the order was placed. Prices include all taxes.
All purchases are non-exchangeable, non-refundable and non-transferable.
In case the media files are damaged or incomplete, you must notify us immediately by e-mail to support@huntersmoonmedia.info. We will replace the media file or give you a full refund if there are any problems affecting that particular media file. We undertake to re-credit you as soon as possible.
Certain tracks available on Hunter’s Moon Records may contain explicit lyrics that may be considered offensive or objectionable, which are generally signalled by the standard notice “parental advisory”. We undertake to display such notice together with the product information, provided that it has been conveyed to us by the record label’s. We shall bear no liability for offensive or objectionable contents within media files that we offer online.
Except where authorised by a record label, you may not use any track as a musical ringer in connection with phone calls.
Intellectual property
For the purpose of these Ts and Cs, ‘Intellectual Property Rights’ means copyright, design rights, trade marks (whether registered or not) and other similar rights (together with the right to apply for the protection of any such rights) belonging to both Hunter’s Moon Media and Hunter’s Moon Distro and companies that supply our website with media files and any related technology, as well as images, samples and text. Any goodwill accruing from use of trademarks, business names and service marks under these Ts and Cs shall vest in their owners as appropriate.
Music files and pages provided through Hunter’s Moon Records download service are digital files protected by national and international laws for the protection of intellectual property rights including, without limitation, copyright.
It is expressly forbidden to copy, distribute, share or otherwise broadcast the media files downloaded from Hunter’s Moon Records.
In an effort to prevent illegal use, media files may carry a digital watermark that allows the tracking of any subsequent illegal transfer. You must not attempt to remove the watermark, damage the file or try to circumvent the security mechanisms in any way. Watermarks enable identification of the unique original owner of the media file, details of which may be conveyed to the copyright owners where there is a reasonable suspicion that copyrights have been violated.
Warranties
This section applies only to the extent permitted by law. For the avoidance of doubt, Hunter’s Moon Records does not exclude or limit any liability for death and personal injury resulting from negligence or wilful default.
The products are provided for private domestic and consumer use only. Accordingly, Hunter’s Moon Records does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the download service or for any products or services purchased from Hunter’s Moon Distro.
Hunter’s Moon Records download services are normally available 24 hours a day. However, Hunter’s Moon Records shall not be liable in the case that the service is temporary unavailable, does not meet individual expectations or is incompatible with software, hardware or telecommunication services. We expressly exclude any liability for the acts or omissions of telecommunications service providers, failures or faults in their networks and equipment.
We shall have no liability to you for any delay in making ordered items available for download or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
Due to new technology developments, market shifts or imperatives, our service offer may vary, as well as media files formats and downloading technologies, without any liability on our part for any damage or loss suffered by the Customers.
In the unlikely event that you receive damaged or incomplete Hunter’s Moon Records items, we will be liable to you for the amount you paid for the items in question provided that you notify Hunter’s Moon Records of the problem in writing at the address stated in the confirmation e-mail within 10 working days of receipt of the items. Our liability to you shall never exceed the total price of downloads or products made by you.
Nothing in this clause affects your statutory rights.
To the fullest extent permitted by law Hunter’s Moon Records are providing this site and its contents on an ‘as is’ basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied with respect to this site or the information, content, materials, warranties or merchantability and fitness for a particular purpose. In addition Hunter’s Moon Records do not represent or warrant that the information accessible via this site is accurate, complete or current.
